Pennsylvania real estate email signature requirements

Pennsylvania's advertising rule, 49 Pa. Code § 35.305, does not mention email, email signatures or any other medium. It says an advertisement by a salesperson or associate broker must contain the employing broker's business name and telephone number, shown at equal size. We found no license-number requirement.

Regulator: Pennsylvania State Real Estate Commission. Summarized from the rule text and official guidance linked below, as of October 15, 2026. Not legal advice.

Does the rule cover email?

  • Section 35.305 never defines “advertisement” and never names email, websites or any other medium. Subsection (c) says “an advertisement by an associate broker, salesperson, cemetery associate broker or cemetery salesperson shall contain the business name and telephone number of the employing broker.”
  • The rule does not say whether a signature on an ordinary email is an advertisement.

Is a license number required?

  • None of the advertising sections we read (49 Pa. Code §§ 35.301 through 35.308) requires a license number in advertising.
  • Section 35.304 requires a licensee who sells or leases his or her own real estate to disclose in advertisements that he or she is a real estate licensee, unless the property is listed with a real estate company.
  • Section 35.305(b) says a licensee who wants to advertise a nickname for a first name must include the nickname on licensure or biennial renewal applications.

Team names

  • Section 35.305 does not mention teams. The Commission's notice “Information from the State Real Estate Commission Regarding Team Advertising” (adopted December 2005, signed January 24, 2006) is a guideline, not a regulation.
  • The guideline says licensees may advertise as a team if: the team name is the licensed or Commission-registered nickname of a licensee on the team and is not a fictitious name (it gives “Benjamin Franklin team” as acceptable and “Franklin team” as unacceptable); on all advertisements except business cards all team members are listed by licensed or registered-nickname name; unlicensed individuals, including office staff, are not listed or pictured as team members; the team is composed only of licensees from the same real estate company; and the requirements of § 35.305, including the prominence requirement of the broker's name and number, are met on each page of the advertisement.
  • The guideline adds that team advertising, like all advertising, cannot be false, misleading or deceptive. It does not mention email.

Anything specific to signatures

  • Section 35.305(c) says the names and telephone numbers shall be of equal size.
  • Annotations on the official Pennsylvania Code page summarize two Commonwealth Court decisions (D'Alonzo, 1997; Campo, 1998) finding violations where advertisements showed the broker's name with a number that connected directly to the salesperson and did not match the number listed for the employing broker.

A practical checklist

Our reading of the rules above, not language from any rule. Your broker-in-charge has the final say.

  • Show the employing broker's business name and the brokerage's telephone number, both at the same size.
  • Do not substitute your own direct line for the brokerage's number.
  • Show the brokerage name as it appears on its license.
  • If you use a nickname, make sure it is on your license record.
  • If you use a team name, follow the Commission's team guideline: the name of a licensee on the team, all members listed, no unlicensed staff.
  • Have your broker confirm the final wording.

What we could not confirm

  • We read § 35.305 and §§ 35.301 through 35.308 on the Pennsylvania Code and Bulletin site, which states it reflects changes effective through 56 Pa.B. 5370 (August 8, 2026). The § 35.305 history note shows the last amendment was effective August 20, 2005.
  • The team notice is dated December 2005 and January 2006. We found no newer Commission statement and could not confirm it is still current policy.
  • A Commission FAQ dated June 2017 is reported in search results to say that email and internet advertising must comply with Section 305. We could not open that document and do not rely on it.
  • We did not read the Real Estate Licensing and Registration Act itself.
